SherlocksPTR Terms Of Service

By signing up and actively using the SherlocksPTR program you agree to all terms and conditions set forth in this agreement. SherlocksPTR may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its affiliates. Affiliates will be informed of any and all changes to this policy via an e-mail to their primary contact e-mail address provided upon signing up with SherlocksPTR. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the SherlocksPTR program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.

Responsibility of Affiliates:
You must be 16 years of age or older to participate in this program. Our program is open to International members, but they MUST BE ABLE TO READ AND UNDERSTAND ENGLISH and is void where prohibited by local governing laws. Any Member clearly unable to read and understand English by failing English Tests of various descriptions (i.e. clicking on 3 or more Cheat Links or Admin Message Tests), will have their accounts deleted and any earnings will be forfeited.Clicking more than 10 turing numbers and your account will be deleted.

You agree to and must use your own name and e-mail address in the sign-up process and may not assume a false identity. You may not sign-up multiple times with different e-mail addresses. Your computer must not be shared with another individual that has an existing SherlocksPTR account.

You will use your e-mail address / password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and following the "User Account Info." link.
You are solely responsible for any and all use of your SherlocksPTR account including authorization by you to any third party individual who may use your account.

Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by Sherlocks PTR be detected it may result in member termination and possible legal action. This includes, but not limited to, the redirection of Member advertised links to anything other than the original page/link as setup at submission of advertising. Any Member found to be changing and/or redirecting links, post setup may have their accounts terminated, forfeiting any earnings accrued.

Any Member posting in Forums or any other media, false and defamatory statements against Sherlocks PTR, it's owners or their other Programs will have their account terminated without warning and any earnings forfeited. Legal Action against individuals and/or mediums that permit such libel, cannot be ruled out. We believe in Freedom of Speech, but will not tolerate false and libelous comments about our businesses. Any queries, comments or problems will be dealt with by using the 'Contact' page or through Our Forum. The email address used when using the Contact page MUST be able to receive replies, if the reply bounces (as many do) we have no other means to contact you to deal with your problem.

You must maintain your email account that you used when signing up to Sherlocks PTR. You agree to receive email advertising from Sherlocks PTR. In the event your email account on file becomes closed or blocked for 7 (seven) or more days to messages from Sherlocks PTR, your account will be terminated and you will forfeit all prior earnings.

If your account is inactive for more than 30 consecutive days your account will be terminated and you will forfeit all prior earnings (Regardless of Account Type). All Members must click at least 30 Links per month or will be classed as inactive - just signing into your account will not suffice. Use of the Paid To Promote (PTP) does not alone constitute being an active Member. Members with the Fancy (Free) Upgrade, inactive for more than 20 Days, will have the Upgrade removed. This does NOT apply to Paid Upgrades.

Auto-responses will also be deleted immediately.

Relationship of the Parties:
You and SherlocksPTR are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and SherlocksPTR. You understand that you do not have authority to make or accept any offers or make any representations on behalf of SherlocksPTR. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.

Limitation of Liability:
SherlocksPTR will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or SherlocksPTR program, even if SherlocksPTR has been advised of the possibility of such damages. Furthermore, SherlocksPTR aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.

Payments:
Affiliates may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by SherlocksPTR. Affiliates may earn by referring new affiliates to the SherlocksPTR program. Affiliates will earn a percentage of advertising revenues collected by SherlocksPTR.

SherlocksPTR will pay affiliates when their balance reaches the minimum payout rate set by SherlocksPTR . Once the member has reached payout they may request payment. However, NEW Members MUST have been a member and be active for 20 days before their first payment can be paid. Payments will be made within 30 days or a reasonable time after. Effective September 1, 2008, Minimum Payout Level is $1.00.

Payments are made using PayPal. If you have a 'Premier' or 'Business' PayPal account you are advised to select 'PayPal No Random' as an option. PayPal charge fees for receiving money to these account and Sherlocks PTR will NOT be responsible for any fees charged. Selecting this option does not prevent you from cashing out at any time, within these Terms, but will ensure that you receive no Random Payouts and therefore losing all earnings in fees for small payout amounts. Reminder, if you do cashout for a small amount, Sherlocks PTR is NOT responsible for any fees charged by PayPal. This does not affect eGold payouts.

Advertising:
Sherlocks PTR is not responsible for content, views and activities etc. of Programs/Websites advertised in the Program. This Program does not necessarily condone, specifically recommend or endorse any Program/Website advertised.

Effective September 1, 2008, all Members must have a Minimum of 50 Clicks per month in order to be paid for promoting Sherlocks PTR PTP Pages.

Sherlocks PTR will not accept advertising for and not limited to, Illegal Activity, Gambling, High Yield Investment Programs (HYIP), or similar, Lotteries, Betting, Auto/Manual Surfs, Adult Material, Nudity, Profanity or any Program/Website deemed to be inappropriate.Members are paid to read emails and view pages/websites. Members are in no way obliged to carry out any other activity i.e. Search, click on other links within advertised Programs/Websites etc. Advertisers will not be permitted to request or force Members of Sherlocks PTR to carry out these actions. Members may search or carry out these activities if they wish - the reward/earnings for the relevant link is purely for reading the advertisement and/or clicking the link/banner.

Searches will only be accepted for advertising in the relevant area and these ads will be targeted to Members that have opted to receive Search advertising. It is the Advertisers' responsibility to request specific geographical targeting of Searches. Sherlocks PTR cannot be held responsible for searches being sent to Members of non-permitted search countries unless the Advertiser has specified target areas PRIOR to the advertising being processed.

Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your affiliateship with SherlocksPTR and may result in legal prosecution. SherlocksPTR strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. SherlocksPTR may charge up to $5 per spam e-mail sent. Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. SherlocksPTR will file charges for recovery of any earnings received from multiple sign-ups.
